Since the introduction of the Simplified Regime in 2001, taxation of income from tourism activities in Category B dropped from 20% to 15%. In contrast, over the same period, income from real estate leasing has been a yo-yo.  Historically taxed at 25%, the levy on long-term renting dropped to 15% in 2001 where it remained until 2013 when it almost doubled, jumping from 15% to 28%. If long-term vacancies are a scarcity in historic neighbourhoods, excessive taxation of landlords will do nothing to increase supply. Local incentives need to be found to resolve neighbourhood problems. Estimates show that only 8% of overall Local Lodging offerings  in Portugal are in these historical localities. Since Local Lodging was reformed into its current configuration in 2014, almost a third of total offerings have been registered and have begun to pay tax. Surprisingly, even though millions of tourists can find holiday lets online, Portuguese inspectors only manage to discover a handful of non-compliant operators. This compares poorly to Barcelona where city examiners raised €600,000 in fines in just 6 months. Once again, the proposed tax hike leaves cheaters untouched while penalising those who play by the rules.

Underground Economy still one quarter of GDP

The unrecorded economy (ENR), better known as the underground economy, rose slightly last year to 27.29% of gross domestic product. The figure represents a modest increase compared to 27.22% in 2014, but shows that programs such as e-invoices and other measures to control the billing in various sectors of activity have had no visible results on the index.

If you exercise the “high value ” profession associated with your Non Habitual Resident application in Category B, the levy is customarily based on 75% of gross income, taxed at a flat rate of 20%. This leaves a final flat rate assessment of 15%, as compared to +40% as a typical higher rate taxpayer.

If your business activity is different from your NHR status, tax is commonly based on 35% of the gross income in the Simplified Regime, then assessed at marginal rates. This leads to a typical final assessment of 10-15%

According to a recent report issued the Economics and Fraud Management Observatory of the  University of Porto, the main causes of tax evasion in Portugal are the burden of direct and indirect tax on businesses and households as well as Social Security contributions. Other causes include the intensity and complexity of laws and regulations (bureaucracy in general) and the lack of credibility of sovereign bodies.

 

EU To Create List Of Non-Cooperative Tax Jurisdictions

The European Commission has confirmed plans to draw up a pan-EU list of non-cooperative tax jurisdictions. The intention is to create a common EU list of non-cooperative tax jurisdictions by the end of 2017. The list will replace the current patchwork of national “black lists,” which are intended to punish those non-EU countries that refuse to comply with international tax good governance standards. The EU list will also help to prevent aggressive tax planners from abusing mismatches between the different national systems of member states.

IMI Supplement to be aggravated

The Rates Supplement (AIMI) will be aggravated to 7.5% for properties registered in offshore companies. The measure is integrated with other changes to the State Budget for 2017. This alteration, together with other modifications to AIMI as well as lower than expected inflation, is intended to help pay for an extra €6 increase in basis pensions, as demanded by the coalition of left-wing parties.

The proposed reduction in the “IRS” surcharge will result in a lowering total personal income tax due by taxpayers in 2017. The State Budget recommends that withholding of this supplementary tax be eliminated in stages.

The Finanças web site will offer an automatic income declaration option for taxpayers to confirm the pre-completed tax information. Over the next few years, all taxpayers with income from Portuguese employment and pensions (currently reporting in the first phase) will have this alternative available.

Golden Visas lose their lustre

Lengthy delays in approving Golden Visas and their renewal are driving investors away from Portugal to other countries with similar programmes, in particular to Spain. Since the 2014 scandal that forced the resignation of high ranking officials, “SEF” (Borders and Immigration Service) has slowed to a snail’s pace the processing of Golden Visas.
