The list of non-cooperative jurisdictions for tax purposes is a tool to tackle:

  • Tax fraud or evasion;
  • Illegal non-payment or underpayment of obligations;
  • Use of legal means to minimise tax liabilities and money laundering;
  • Concealment of origins of illegally obtained money.

The EU blacklists countries that encourage abusive tax practices that erode member states’ corporate tax revenues. Member states can act together to press for reform. The aim is not to “name and shame” countries but rather to encourage positive change in fiscal legislation and practices through cooperation. Once a jurisdiction is compliant, it can be removed from the European Union’s blacklist.

According to financial standards of opacity, Delaware has the dubious honour of being classified amongst the top least transparent tax havens as determined by the Tax Justice Network. Tax authorities around the world lose hundreds of billions of Euros each year in tax revenues due by high net worth individuals as well as major corporations who hide their assets in offshore structures. Compounding the problem are the added links to money laundering, the financing of terrorism and global drug trafficking networks. Continue reading →

The European Commission has confirmed plans to draw up a pan-EU list of non-cooperative tax jurisdictions. The intention is to create a common EU list of non-cooperative tax jurisdictions by the end of 2017. The list will replace the current patchwork of national “black lists,” which are intended to punish those non-EU countries that refuse to comply with international tax good governance standards. The EU list will also help to prevent aggressive tax planners from abusing mismatches between the different national systems of member states.
