The Stability Program for 2019-23 anticipates €31 million in additional tax revenues from the new maximum tax bracket for AIMI, applicable to Ratable Values (“VPT”) above €2 million. The Additional to Municipal Property Tax was first created in 2017 targeting luxury properties. Beyond the standard “IMI” assessment, Companies are charged AIMI at a rate of 0.4% on the sum of the Rateable Values of these properties. Residences held by entities in tax havens pay 7.5%. In the case of individual ownership, an AIMI rate of 0.7% is applied on “VPT” totals above €600,000 (or double this amount for married and cohabiting couples who opt for joint “IRS” declarations). When the “VPT” values exceed €1 million, the tax rate increases to 1%. The new bracket, created in the recent State Budget to be applied for the first time in 2019, foresees an AIMI tax rate of 1.5%, applicable to “VPT” amounts above €2 million.

Portugal received 128,000 fewer foreign visitors this summer than in the same period last year, a drop largely due to fewer holidaymakers from the United Kingdom. Between June and September, 5.5 million travellers came to Portugal, down 2.2% when compared to the same period in 2017. However, revenues rose to 1.7 billion euros during the period, up 4.4%.

Reporting possible tax evasion in Local Lodging and failure to issue invoices by merchants allowed the Portuguese Revenue to collect an additional €1,000,000 in 2017. The anti-fraud division of the “AT” received and analysed 2,618 complaints and accusations of which 2,153 were made by other public entities, and 465 came from complaints by private individuals.

Tax receipts from Local Lodging (“AL”) grew from €69,000,000 to €123,000,000 between 2015 and 2017, as revealed by the Secretary of State for Tourism, Ana Mendes Godinho. “AL” license registrations also increased almost twofold from 28,000 to over 50,000 over the same period.

Introduced in 2017, the Additional Municipal Property Tax (AIMI) produced less than 40% of the expected tax receipts as forecasted by the Ministry of Finance. Instead of the €130,000,000 as originally estimated by the Government, AIMI taxation will give rise to just €50,000,000, far below expectations.

NHR proves to be positive

Despite millions in tax concessions, the overall impact on tax revenues from Non-Habitual Residents has proven to be propitious for Portugal, due to total taxable income generated, such as capital gains, rates, VAT, etc. Simultaneously, there is also a significantly healthy impact on local economies arising from new construction, urban rehabilitation and real estate transactions.

Based on the number of overnight stays last year (6.8 million) to be charged at 2 euros per night per person, the total anticipated revenue for the municipality is expected to reach 13 million euros. The city is preparing the process of applying the new tourist tax and anticipates implementing the new levy in January next year.
